Builtrite Systems (Seller) expressly warrant all door and glazing frame components manufactured by Seller to be free of defects in materials and workmanship subject to the following terms, conditions and limitations:

 

(a) The components must be properly installed by mechanics experienced and knowledgeable in their field and in compliance with any installation instructions provided by Seller;

 

(b) The components must be used under normal conditions of service;

 

(c) The warranty is for a term of one (2) years from the date of shipment to the buyer;

 

(d) Alleged defects must be inspected by Seller’s agent at the time mutually convenient to both Seller and buyer (and/or buyer’s client);

 

(e) The Seller’s only liability for breach of this expressed warranty is, at Seller’s cost, to replace such defective component(s). An estimate of the cost for such removal and replacement must be submitted and approved by Seller. Seller will not be responsible for the cost of removal and reinstallation. If the defect was apparent prior to installation; in this case, Seller’s liability will be limited to Seller’s cost of the defective component(s);

 

(f) Seller makes no express or implied warranties including, but not limited to, any implied warranty of fitness for a particular purpose, except as expressly set forth in the above warranty. In no event shall Seller be liable for any incidental or consequential damages arising out of, or in connection with, the use, or performance of the components warranted hereunder.
